At TSCHIFFELI & PARTNERS we strive to establish and maintain a relationship of mutual trust with our clients.
In order to enhance transparency, we make sure that clients are well-informed about our fee structure and billing practice.
We usually charge on an hourly rate basis for work performed.
Depending on the nature, complexity and degree of urgency of the service, hourly fee can range between CHF 400 (EUR 360 / USD 410) and CHF 600 (EUR 540 / USD 615).
We may consider quoting a fixed price to the client for a service comprising few unknown quantities.
In exceptional circumstances where the financial stake can be evaluated, it's possible to agree fees calculated by application of a decreasing percentage of the gross amount recovered by settlement. The client can expect the contingency fee to be between 15% to 40% of the compensation that is awarded to him.
A combination of lump sum and hourly rates is also possible.
We require reimbursement of third party and out-of-pocket expenses, unless otherwise specified.
We are often requested to estimate the amount of fees and costs likely to be incurred in connection with a particular matter. On demand only, we will provide such a general guide based upon our professional judgment, but always with a clear understanding that it is not a firm quotation. The ultimate cost frequently is more or less than the amount estimated.
We ordinarily require a retainer fee deposit which will be applied toward expenses, disbursements and fees incurred in client's matter. We will then bill our time against the retainer on a regular basis, according to the agreed fee schedule.
This retainer depends on the nature and degree of complexity of the matter.
Without the full payment of this retainer, we do not take any action.
We track our time spent on the matter in 60 minute increments.
We will submit to the client, at regular intervals, periodic statements of services rendered setting forth the chargeable time allocated to client's matter.
Time spent will be charged against the retainer until it is used up. If the retainer is exhausted, the client agrees to remit to us any additional amounts we request.
Details of time spent and work carried out are systematically included in our statements.
All invoices are payable by bank transfer, within 7 working days of the date of the invoice.
In case of non-payment of an invoice on its due date, an annual interest of 5% of the outstanding amount will be applied as well as a fixed allowance of CHF 120 (EUR 108 / USD 123).
Letter of Engagement
Before starting any work, we will provide the client with a signed agreement which defines, amongst others, the service scope, fee schedule, billing terms and the related details.
The client may freely terminate the agreement upon upon 7 working days prior written notice. In this regard, the client remains responsible for payment of all outstanding amounts accrued up to the date of termination.
We also have the right to terminate the letter of engagement whilst respecting the applicable rules of deontology.
